Baldoyle Blinds Ltd
Terms & Conditions
of Sale.
These terms apply to orders for blinds, curtains, shutters, tracks, poles, motors, controls and related products, including installation where applicable.
Delivery, cancellation & returnsBefore you order
- A survey request or shop basket sent for review is an enquiry. A successful VELUX online payment places the order shown at checkout.
- Check the specification, total price, payment schedule and timing in your written order.
- Personalised goods and standard goods have different change-of-mind rules.
- Your rights for faulty or misdescribed goods apply to both.
Made-to-measure and bespoke products
Many products are made to your measurements or otherwise clearly personalised. Standard, non-personalised shop goods are treated separately.
The statutory change-of-mind cancellation right does not generally apply to goods made to your specifications or clearly personalised. Merely ordering a standard item from a supplier does not, by itself, make it personalised. Please contact us promptly about any requested change; we will explain what is possible and any agreed costs.
This does not affect statutory rights where goods are faulty, do not conform to the contract or another statutory remedy applies.
Order confirmation
The customer is responsible for reviewing the order confirmation carefully before approving it, including product type, quantity, fabric, colour, finish, controls, dimensions, fitting location, opening configuration, curtain specifications, shutter configuration and accessories.
Once approved and submitted for manufacture or purchasing, changes may not be possible. Where a requested change is possible, additional charges and revised lead times may apply.
Measurements
Where we survey, measure and install an order, we are responsible for manufacturing to the measurements taken by us, subject to the agreed specification and reasonable manufacturing and installation tolerances.
Measurements supplied by the customer, builder, architect, designer, contractor or another third party are supplied at the customer’s responsibility. We are not responsible for products that do not fit because those measurements were inaccurate. Allowance should be made for handles, tiles, architraves, skirting, radiators, openings and other obstructions.
Site conditions and customer responsibilities
Tell us before manufacture or installation about anything that could affect suitability or fitting, including concealed services, underfloor heating, asbestos, unsuitable walls or frames, plasterboard cavities, steel lintels, restricted or high-level access, alarm sensors, ventilation, handles and opening restrictions.
The installation area must be reasonably accessible, with furniture, valuables and fragile items removed or protected. Additional charges may apply where specialist access, extra labour, electrical or remedial works, or a return visit is required because of circumstances outside our reasonable control.
Product appearance, samples and natural variations
Samples, displays, photographs, brochures and digital images provide a reasonable representation only. Colour and texture can vary with lighting, surrounding décor, screen settings and manufacturing batches.
Textiles, timber and natural or semi-natural materials may have reasonable variations in weave, grain, texture and appearance. Fabrics may also vary naturally in drape, fullness, movement, pattern alignment, creasing and settling. Normal material characteristics and reasonable manufacturing tolerances do not, by themselves, constitute a defect.
Shutters
Made-to-measure shutters may require frames, build-outs, T-posts, rails, panel divisions or other components. Final configuration can be influenced by manufacturing limits, dimensions, handles, openings and structural requirements. Reasonable operating gaps and tolerances may be required.
Unless agreed otherwise in writing, shutters and blinds are window coverings and are not represented as providing complete blackout.
Curtains
Curtain appearance depends on fabric, heading, lining, fullness, dimensions and the installation environment. New curtains may require a settling period, and packaging or transport creases will generally reduce naturally.
Pattern positioning and matching follow reasonable manufacturing practice, but exact placement is not guaranteed unless agreed in writing. Temperature, humidity and fabric characteristics can cause natural movement and slight dimensional variation.
Motorised and electrical products
Baldoyle Blinds does not connect hardwired motors to the mains supply. We install the product and programme, configure and test the motor and controls insofar as possible before connection. All mains supplies, sockets, fused spurs, wiring and final connection are the customer’s responsibility and must be completed by a suitably qualified electrician.
If power is unavailable at installation, we will explain which commissioning checks remain and agree the next step. Responsibility for electrical provision and any further visit must be clear in the quotation. Report product or programming issues to us; mains wiring and supply issues should be referred to the electrician.
Battery and solar performance depends on use and environmental conditions. Wi-Fi, radio, apps and smart-home functions can be affected by networks, signals and third-party services outside our control. We confirm supported controls and any network requirements before you order. Changes to third-party platforms can affect connected features. This does not remove our obligations for agreed functionality or any updates and remedies required by law.
Quotations
Quotations are based on the information, dimensions and specifications available when prepared and may be revised if these change. Any stated validity period applies. If none is stated, pricing may be revised before acceptance where supplier, material or other relevant costs change.
A quotation is not acceptance of an order until Baldoyle Blinds confirms it and receives the required deposit or payment.
Deposits and payment
Unless agreed otherwise in writing, orders scheduled for installation within two weeks of confirmation require full payment when confirmed. Orders scheduled more than two weeks after confirmation require a 50% deposit, with the remaining 50% paid in full before installation.
Payment can be made by cash or card in our Baldoyle showroom, by card over the phone, through a personalised secure Square invoice or payment link, or by electronic funds transfer (EFT). Bank details can be requested directly from our office. For fraud prevention, customers should verify bank details with our team using the contact information published on this website before making an EFT payment, particularly if they receive any request advising that our bank details have changed.
Secure online payments powered by Square · Card · Apple Pay · Google Pay
Where we issue a Square invoice or payment link, card and digital-wallet details are entered through Square’s payment service and are not collected through the Baldoyle Blinds website. Customers should check the business name, order reference and amount displayed before paying and contact us if anything appears incorrect.
Installation teams do not accept cash, card or other payments on the road. Installation will not proceed while a balance remains outstanding and may be postponed until payment is received. A reasonable communicated call-out or rescheduling charge may apply where an appointment cannot proceed due to non-payment.
Payment confirms that the customer wishes us to proceed subject to these terms. Once manufacture or purchasing has commenced, payments may be retained only to the extent permitted by law and having regard to costs and losses reasonably incurred. Statutory rights remain unaffected.
Cancellation and amendments
Contact us as soon as possible about a requested change or cancellation. Written notice helps keep a clear record, but does not replace any statutory way of exercising a cancellation right. We will explain whether a requested change is possible and any lawful costs.
For personalised goods, cancellation or amendment can become impractical once work or committed costs begin. Any charge must be lawful and reflect the circumstances. Standard goods bought at a distance can have statutory cancellation rights even if ordered in from a supplier. See our delivery, cancellation and returns information.
Manufacturing and lead times
We distinguish estimated manufacturing times from an agreed delivery period or installation appointment. Agreed dates and your legal rights if delivery is late are not removed by describing general lead times as estimates. Supplier or manufacturing delays, transport disruption, availability, customs, staffing and events outside our reasonable control may affect lead times.
We will make reasonable efforts to communicate significant delays. Do not arrange dependent works or remove existing coverings solely on an estimated date unless specifically agreed.
Delivery and installation
Installation is carried out with reasonable care and skill and may require drilling into walls, ceilings, frames or surrounding surfaces. Reasonable minor marking associated with normal installation can occur.
We are not responsible for pre-existing defects, unsuitable substrates or concealed services that were not reasonably identifiable and were not disclosed. We may postpone work where site conditions, access or incomplete works prevent safe or proper installation. A further charge may apply where another visit is required for circumstances outside our responsibility.
Installation appointments and access
A responsible adult must provide access at the agreed time unless alternative arrangements are agreed. Appointment windows are estimates and can be affected by traffic, previous installations and circumstances outside our control.
If access is unavailable or the area is not ready, the visit may be rescheduled and a reasonable additional charge may apply.
Inspection and reporting issues
Inspect products following delivery or installation and tell us promptly about any fault, damage, incorrect item or specification discrepancy. Photographs and a description may help us investigate.
We ask that visible issues are reported within seven days so they can be investigated quickly. This requested period does not limit statutory rights. We may need to inspect the reported issue, but this does not require you to accept a repair where you have a right to a refund.
Repairs and remedial works
Where a product or installation does not conform to the contract, the appropriate remedy will be provided under Irish consumer law. If faulty goods are rejected within the applicable first 30 days, you can exercise the short-term right to terminate and receive a full refund. After that, repair or replacement will usually apply, with price reduction or termination available in the circumstances provided by law. Serious faults can justify a refund without first accepting a repair.
We must be given reasonable access and opportunity to carry out an applicable remedy. Do not arrange third-party alteration, repair or replacement and then seek reimbursement without first allowing us to inspect and address the issue, except where the law provides otherwise or urgent circumstances reasonably require it.
Warranties
Any commercial or manufacturer’s warranty is additional to, and does not replace or restrict, statutory rights. Products and components can have different warranty periods, stated in the relevant documentation, quotation, order confirmation or manufacturer’s terms.
A commercial warranty may not cover misuse, accidental damage, unauthorised alteration, failure to follow instructions, unsuitable environmental conditions or normal wear and tear, subject always to statutory rights.
Child safety
Window coverings must be used with applicable child-safety requirements and supplied safety devices. Devices must not be removed, altered, disabled or bypassed. Cords, chains and operating mechanisms must be kept out of children’s reach and fitted safety devices kept operational.
Existing products and customer-supplied items
Work on an existing product or an item not originally supplied by us is subject to its condition and suitability. Components can become brittle, worn or damaged and compatibility cannot always be guaranteed.
We use reasonable care and skill but cannot guarantee the continued serviceability of pre-existing parts that are worn, damaged, incompatible or beyond their reasonable service life.
Removal and disposal
Removal or disposal of existing coverings is not included unless stated in the quotation or order confirmation. Additional charges may apply where agreed. Unless agreed otherwise, the customer must arrange for any existing products they wish to retain.
Customer delays and storage
The premises should be made available within a reasonable period once products are ready. Alternative arrangements may be agreed where installation is postponed. Reasonable communicated charges may apply where substantial storage, repeated delivery attempts or repeated appointments are required because of customer delay.
Care and maintenance
Products must be operated and maintained according to our or the manufacturer’s instructions and must not be subjected to excessive force, unsuitable cleaning products, excessive moisture or inappropriate conditions.
Misuse, accidental damage, unsuitable cleaning, unauthorised alteration or failure to follow reasonable instructions may not be covered by a commercial warranty, subject to statutory rights.
Liability
Nothing in these terms excludes or restricts liability or a consumer remedy that cannot lawfully be excluded. We are not responsible for loss or damage caused by inaccurate customer or third-party information, undisclosed conditions, misuse, unauthorised modifications, failure to follow instructions or matters outside our reasonable control, except to the extent caused by our breach of legal obligations.
Events outside our reasonable control
We are not responsible for delay or failure where performance is prevented or materially delayed by severe weather, fire, flooding, transport disruption, industrial disputes, supplier disruption, customs delays, material shortages, outages, government restrictions or comparable circumstances outside our reasonable control.
We will make reasonable efforts to minimise disruption and complete the order as soon as reasonably practicable. Consumer rights remain unaffected.
Photographs
We will not use photographs of a customer’s property for advertising, social media or promotion without permission where permission is required. A customer may decline without affecting their order.
Complaints
Contact us promptly with your name, order details and a description of the concern. We may reasonably request photographs, video, information or access for inspection. We will investigate and seek to resolve valid concerns within a reasonable timeframe and in accordance with applicable consumer law.
Irish consumer law
Nothing in these terms excludes, restricts or diminishes mandatory rights or remedies under Irish law, including the Consumer Rights Act 2022. If a provision conflicts with a mandatory right, that right prevails and the remaining provisions continue insofar as permitted.
Severability
If a provision is invalid, unlawful or unenforceable, it will be treated as removed only to the minimum extent necessary. The remaining provisions continue in effect.
Governing law
These terms and any contract between Baldoyle Blinds Ltd and the customer are governed by Irish law. Nothing deprives a consumer of mandatory jurisdictional rights.
Google address suggestions
The optional address suggestions in our survey form use Google Maps Platform and are subject to the Google Maps Terms of Service. Please check the selected address and add any missing house or apartment number or Eircode. Suggestions do not confirm delivery, service coverage or an appointment. You can always enter your address or area manually. See our privacy notice for details.
